DMCA and Copyright Policy

Overview

PodPast.ai respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512. PodPast.ai stores only user-authorized transcript data within private vaults. Audio files are never retained — they are streamed directly to Deepgram for transcription and immediately discarded. Transcripts are stored privately and are not made publicly accessible unless the user explicitly chooses to share them (a feature not yet available).

Designated agent

PodPast.ai has registered a designated agent with the U.S. Copyright Office pursuant to 17 U.S.C. §512(c)(2). To submit a DMCA takedown notice, contact our designated agent at:

How to submit a takedown notice

To submit a valid DMCA takedown notice under 17 U.S.C. §512(c)(3), your written communication must include all of the following elements:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit PodPast.ai to locate the material.
  4. Information reasonably sufficient to permit PodPast.ai to contact the complaining party, such as an address, telephone number, and, if available, an email address.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Incomplete notices may not receive a response. Knowingly submitting a false DMCA notice may result in liability under 17 U.S.C. §512(f).

Counter-notice process

If you believe that material removed in response to a takedown notice was removed in error, you may submit a counter-notice under 17 U.S.C. §512(g). A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location where the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or any judicial district if your address is outside the United States), and that you will accept service of process from the person who provided the original notification or an agent of such person.

Upon receipt of a valid counter-notice, PodPast.ai will notify the original complainant and may restore the material not less than 10 nor more than 14 business days after receipt of the counter-notice, unless the copyright owner files an action seeking a court order.

Repeat infringer policy

PodPast.ai will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances. A "repeat infringer" is a user who has been the subject of multiple valid DMCA takedown notices. PodPast.ai reserves the right to terminate accounts at its discretion when the circumstances warrant it, consistent with the safe harbor provisions of 17 U.S.C. §512(i).

Note on stored content

PodPast.ai stores only transcript text and vector embeddings within user-controlled private vaults. Audio files are never retained. If a takedown notice identifies transcript content derived from a copyrighted work, PodPast.ai will delete the relevant transcript chunks and embeddings from the affected user's vault upon receipt of a valid notice.
